• As a buyer, should i pay house agent comission?

The house agent claimed i should pay to him since he brought me to the seller and claimed he has worked for me. i' m a bit confuse because i did call him to ask about the house and i agreed to buy the house after several negotiation with him as mediator and final stage with the owner of the house. But i never appoint him as my agent. He said that i should pay him because it is standard practise in Penang that both party will pay 1% comission each to the agent. Furthermore he is not listed agent. But i'm sure the owner has paid him the comission. Maybe 1%.

      The Board of Valuers,Appraisers & Estate Agents Malaysia has given guidelines on professional ethics and maximum fees chargeable by estate agnets. Estate agents can either be engaged by the Owner/Landlord or the Buyer/Tenant but estate agents cannot collect agency fees from both Owner/Landlord and Buyer/Tenant.If you are responding to the Estate Agent's property listing that is advertised then that Estate Agent is likely to have been engaged by the Owner/Landlord and a fee has been agreed to be paid by Owner/Landlord. Sometimes we have Buyer/Tenants who needed our services to find them a unique property at good prices or terms, then they will agree to pay us a fee upon success basis before we embark on the search and information gathering. Hope this will clear the air about our estate agency profession to clients like you.

      Here's the way, Penang Real Estate Agency is taking commision from both side owner 1% buyer 1%.
      Penang all agency is do the same way. only KL Real Estate Agency is only owner pay 2% to as agent fee.

      Thanks Mr David and Mr Low for your professional advise. I don't understand why buyer should pay the comission to the house agent that being appointed by seller and actually act onbehalf the seller not buyer. I think what is said as standard practise in Penang that the buyer and seller pay 1% each to the agent is wrong practise.

      only at penang area buyer need to pay 1% commision from purchase price. if at kl, selangor, is no need for buyer

      Fellows REA & REN, We are practicing a win-win-win rules in properties market. The involved party are Tenant/Purchaser-Landlord-Agent. There is a case which seller did not want to pay commission to the agent, so what the agent do is he collect commission from the purchaser. The purchaser is happy to pay, the seller is happy to sell his property and the agent is happy to close deal.

      David Wong Lai Kwong is right. That's the offical stand that both the Board of Valuers, Appraisers and Estate Agents and The Malaysian Institute Of Estate Agents (MIEA)are taking. For your info, I have served as a member of the the Board and also previously as Acting President of MIEA. The only reason why I mentioned my background is to help clear the air once and for all. As register estate agents, it is our duty to educate the public on estate agency practice.

      Mr Andrew, if u being appointed by seller, so the seller is ur client and he should pay for what u had expense. I am a buyer, so whay i should pay u? I did not appoint any agent to find the house for me. I just call the seller's agent to ask the price and had few negotiation.
